Missing the regular Income Tax Return (ITR) filing deadline does not necessarily mean that your opportunity to file the return or claim an eligible tax refund is over. For Assessment Year (AY) 2026-27, relating to income earned during FY 2025-26, taxpayers who miss the applicable original due date may still have the option of filing a belated return up to December 31, 2026, subject to the provisions of the Income-tax Act, 1961 and completion of assessment.
This additional window can be particularly important for salaried individuals, pensioners, professionals and other taxpayers whose employers, banks or clients deducted more TDS than their final tax liability. It also gives taxpayers time to carefully reconcile Form 16, Form 26AS, AIS and other financial records before submitting a late return. However, belated filing may involve a late-filing fee and other consequences, so December 31 should not be treated as a routine extension of the original deadline.
A taxpayer who was required to file an income tax return but could not submit it within the original deadline can generally file a belated return under Section 139(4).
For AY 2026-27, the Income Tax Department's guidance states that a belated return may be furnished on or before December 31, 2026, or before completion of assessment, whichever is earlier.
This means taxpayers should not assume that missing the original deadline permanently closes the door on filing their return.

Before filing a belated ITR, taxpayers should carefully reconcile their financial information.
Start with Form 26AS, which provides important tax-credit information, including TDS and TCS records. Then review the Annual Information Statement (AIS) and Taxpayer Information Summary (TIS).
Compare these records with:
A mismatch between the return and information available with the tax authorities can lead to processing differences, notices or refund delays.

According to the Income Tax Department's guidance for AY 2026-27, the late-filing fee under Section 234F can be:
₹1,000 where total income does not exceed ₹5 lakh.
₹5,000 in other applicable cases.
Depending on the taxpayer's circumstances, interest and other consequences may also apply.
Therefore, a belated return should be viewed as a compliance safety net rather than an alternative deadline taxpayers should intentionally wait for.
A different situation arises when the return was filed on time—or even belatedly—but you subsequently discover an error.

The Income Tax Department confirms that taxpayers who discover mistakes in a submitted return can revise it, subject to the applicable statutory conditions and deadline.
Importantly, the rules for AY 2026-27 are changing compared with earlier assessment years. The department's current guidance says the revised-return window for AY 2026-27 extends to March 31, 2027, while additional fees may apply when revision takes place after December 31.
Therefore, December 31, 2026 is especially important for belated filing, but taxpayers correcting an already-filed AY 2026-27 return should check the revised-return provisions separately.
Understanding the difference is important.
A belated return is generally used when you did not file your original ITR within the prescribed original due date.
A revised return is used when you already filed a return but later discover an omission or incorrect statement that needs correction.
For example:
Rahul completely forgot to file his AY 2026-27 return. He may consider filing a belated return within the permitted period.
Neha filed her ITR but later discovered that interest from a fixed deposit was missing. She may need to file a revised return.
The appropriate route depends on whether a valid return has already been filed and the nature and timing of the correction.
An Updated Return (ITR-U) provides another mechanism for correcting certain tax situations after the normal filing or revision windows.
However, ITR-U should not be confused with a belated or revised return.
The Income Tax Department states that an updated return cannot be used in a manner that decreases total tax liability, increases a refund, or results in an enhanced loss.
The notified ITR-U framework also covers circumstances such as previously unreported income, incorrectly reported income, incorrect heads of income and other specified corrections.
Therefore, taxpayers primarily trying to claim an additional refund should not assume that they can simply wait and use ITR-U later.
First, log in to the official Income Tax e-Filing portal and select the appropriate assessment year—AY 2026-27 for income earned during FY 2025-26.
Next, determine the correct ITR form based on your sources of income. The department has made AY 2026-27 return utilities available for applicable ITR forms.
Then reconcile Form 16, Form 26AS, AIS, bank statements and investment records.
Calculate your total taxable income and final tax liability. If additional tax is payable, complete the required tax payment before submitting the return where applicable.
Enter the correct bank account information, particularly if you expect a refund.
Finally, submit the return and complete the applicable e-verification process. Filing the form without completing required verification can create unnecessary complications.
Sometimes a return is successfully processed and a refund is determined, but the amount does not reach the taxpayer's bank account.
In such cases, taxpayers can use the Refund Reissue facility on the e-Filing portal where applicable. The Income Tax Department's guidance states that a refund reissue request requires the return to have been filed and a refund failure to have occurred.
Bank account validation, PAN details and other information should therefore be checked carefully.
The December deadline can create last-minute pressure, but filing incorrect information simply to meet the date can create another problem.
Before submission, check your PAN and personal information, bank account, salary income, interest, capital gains, house-property income, TDS/TCS, advance tax, self-assessment tax and eligible deductions.
Also ensure you have selected the appropriate tax regime and applied deductions and exemptions according to the regime and rules applicable to you.
Taxpayers with business income, foreign assets, overseas income, complex capital gains or substantial AIS mismatches may benefit from professional tax advice before filing.
Missing the original ITR filing deadline for AY 2026-27 does not automatically mean you have lost the opportunity to file your return or claim an eligible refund. Under the current rules, a belated return can generally be filed up to December 31, 2026, subject to completion of assessment and other statutory conditions. Late-filing fees may apply.
Taxpayers who have already filed but discover mistakes should distinguish a revised return from a belated return. For AY 2026-27, current Income Tax Department guidance provides an extended revised-return window up to March 31, 2027, with additional fee implications for revisions after December 31.
The key is not merely to file before the last possible date, but to file an accurate return after reconciling Form 16, Form 26AS, AIS, bank records, investment details and taxes already paid.
